Speaker Clarifies… Matthew Nyindam Still Remains MP For Now
The Speaker of Parliament, Rt. Hon. Alban Sumana Kingsford Bagbin, has noted that it is too premature to say that the Member of Parliament for Kpandai, Hon. Matthew Nyindam is disqualified from entering the Chamber and Participating in the proceedings of the House.
Making a formal communication on the Tamale High Court’s annulment of the 2024 Parliamentary election results for the Kpandai Constituency and whether Hon. Nyindam has the right to participate in Parliamentary proceedings, the Speaker was of the view that the period from the time Parliament was served with the decision of the High Court falls within the seven (7) days mandatory stay of execution order until 1st December 2025.
“This is not a declaration order, this is an execution order that was delivered by a High Court. He is right to have participated in the debate” he stated.
Backing his clarification that Hon. Matthew Nyindam still remains a Member of Parliament for Kpandai until the expiration of the seven days stay of execution order, the Speaker indicated that provision of Court of Appeal rules 1997 CI 19 as amended in the Court of Appeal 2020 CI 132 rule 27 /3, states that “There shall be a stay of execution of judgement or decision appeal against for a period of seven (7) days immediately following a given notice of judgement or decision”.
According to the Speaker this rule appears mandatory, and it applies in every High Court decision capable of appeal.
